HENRYETTA, OKLAHOMA: The State Department of Corrections has revealed that convicted sex offender Jesse McFadden was not on probation following his release from prison in 2020 after serving 16 years for a 2003 rape conviction. He was reportedly required to check in with the Okmulgee County Sheriff’s Office every 90 days but was not placed under the jurisdiction of a probation officer. An investigator from Okmulgee County compared McFadden's compliance check to throwing darts and also revealed that he was a "Level 4" inmate in prison.
McFadden was sentenced to 20 years in prison for a 2003 rape conviction in Pittsburg County. As per an investigation conducted by News 4, he also concurrently served eight years for grand larceny during the same sentence. In 2017, McFadden was charged with soliciting sexual conduct with a minor with technology and possession of juvenile pornography after being found with a cell phone in 2016. However, he was still released from prison in 2020.

In November 2020, McFadden was possibly arrested over a child porn case as his bond was reportedly set at $25,000. He allegedly posted the bond on November 19, 2020, and was eventually allowed to walk free. Since his release, the jury of McFadden’s case was pushed off several times before being scheduled for May 1, 2023. Hours before the trial, authorities discovered seven bodies at McFadden’s Henryetta home. It was revealed that McFadden shot and killed his wife, Holly, and her three children, Tiffany, Michael, and Rylee, along with missing teenagers Ivy, 14, and Brittany, 16, who were spending the weekend with the family. Shortly after, he turned the gun on himself.
Jesse McFadden was a Level 4 inmate in prison
During his time in prison, McFadden was considered a “Level 4 inmate,” Oklahoma Department of Corrections Acting Chief of Communications, Kay Thompson, told News 4. “State statute dictates ODOC base an inmate’s incarceration on a level system that determines custody level, job status, program status and privileges,” he explained. “The level system (OP-060107) encompasses multiple criteria including behavior and attitude, program and education assignments, and general hygiene,” Thompson continued.
The ODOC systems of incarceration also mentioned that for a level four inmate, McFadden had to have maintained an “outstanding attitude and relationship with staff and other inmates,” the publication noted. However, McFadden’s status was downgraded after he was caught with a cell phone and charged in a child porn case the following year for sexting a minor. “McFadden was a Level 4 inmate for most of his incarceration, however, he was assigned to Level 1 in January 2017 following his misconduct occurring in December 2016,” Thompson stated.
As per court documents, the photos of the victim appeared to be in “different stages of undress.” The conversation between McFadden and the teenage victim also showed “sexually-themed conversations.” The device also contained explicit photos of McFadden, court records revealed. However, McFadden returned to level four status once again in June 2017, only five months after being accused. He then completed 85% of his sentence as required by the state.
“Inmate Jesse McFadden was sentenced to 20 years in 2003 and was received into ODOC custody in January 2004. Per state statute, for his conviction, McFadden had to serve no less than 85% of his sentence, which is a minimum of 17 years. Inmates are given credit for time served within county jails, which in his case was 76 days,” Thompson shared.
Jesse McFadden had compliant checks instead of being on probation
Despite facing two child pornography-related charges, McFadden was released from prison in October 2020. Thompson explained that the convicted felon was not placed on probation but instead asked to check in with the Sheriff’s Office every three months in which he was “compliant.” However, an investigator from Okmulgee County Sheriff’s Office presented a different picture while speaking to News 4 last week.
As the family of Ivy Webster, McFadden's victim, walked the Henryetta home where Ivy was killed alongside five other individuals, the latter’s father, Justin, asked, “So who is supposed to be checking on the sexual offender?” In response, the investigator said, “It’s public record. It’s everywhere.” When Justin reiterated saying, “So nobody is supposed to come and do checks?” the officer responded, “We do compliance checks but it’s like throw a dart, see which we’re going to do because that’s all the resources we have to do.”
‘Everyone should be fired from that department’

“Lame excuses....they should be held liable and lose their jobs,” added another. “Omg. Are you kidding me. In other words they don’t worry about it because they don’t have the resources,” a third user commented in disbelief. One said, “Another pathetic excuse for not doing your job LE!!!” while another mocked officials saying, “What kind of Mayberry, Barney Fife operation are they running in Okmulgee?
