The former Marine who held Jordan Neely in a fatal chokehold on a Manhattan subway earlier this month is expected to surrender to New York authorities today to face criminal charges over his death. Daniel Penny, 24, will be arrested on a second-degree manslaughter charge on Friday morning before being arraigned in Manhattan Criminal Court. “We can confirm that Daniel Penny will be arrested on a charge of Manslaughter in the Second Degree,” a spokesperson for Manhattan District Attorney Alvin Bragg’s office confirmed in a statement to The Independent. “We cannot provide any additional information until he has been arraigned in Manhattan Criminal Court, which we expect to take place tomorrow.” Mr Penny was filmed wrapping his arm around Neely’s neck on the floor of a train carriage after the 30-year-old homeless man apparently suffered a mental health episode. The death of Neely, known to New Yorkers for his impersonations of Michael Jackson on the city’s streets and subway, has led to widespread criticism and protest.
