Donald Trump is widely expected to be indicted imminently by Justice Department special counsel Jack Smith over his efforts to overturn the 2020 US presidential election result and his role in inciting the Capitol riot of 6 January 2021. Should that happen and he is brought to trial in Washington DC, Mr Trump would appear before a judge selected at random to oversee the case in accordance with the local rules. However, since he was the 45th president of the United States, Mr Trump stands a one-in-three chance of coming up against a jurist he personally appointed. Four of the 12 district judges currently active in DC – Judges Timothy Kelly, Trevor McFadden, Dabney Friedrich and Carl Nichols – were elevated to their current positions during the Republican’s four years in the White House between 2017 and 2021, meaning, at least at that point, he believed them to be politically sympathetic to his own values. Both Judge McFadden and Judge Nichols have raised eyebrows since then through their handling of January 6 defendants, the former delivering the only acquittal in a bench trial resulting from the failed insurrection and attempting to waive grand jury secrecy in court and the latter finding himself in disagreement with no fewer than 10 of his peers when he ruled that the Justice Department could not charge the accused rioters with obstruction of an official. The remaining eight active justices were appointed by either Barack Obama or Joe Biden, which, following the same logic, suggests they are likely to have more Democratic leanings. The ranks of DC’s senior judges, meanwhile, include veterans appointed during the Ronald Reagan, Bill Clinton and George W Bush administrations, two of whom – Emmet Sullivan and Amy Berman Jackson – have a recent track record of making enemies of Trumpworld luminaries. Judge Sullivan told Mr Trump’s short-lived first national security adviser Michael Flynn in 2018 that might have been charged with “treason” over his undeclared lobbying on behalf of the Turkish government, drawing the ire of the MAGA movement, while Judge Jackson attracted headlines when she issued a gag order against self-styled Republican political fixer Roger Stone after he posted a picture of her on Instagram with a rifle’s crosshairs zeroing in on her forehead. As for DC’s juror pool, citizens of the nation’s capital have distinguished themselves in recent years through their careful and considered handling of January 6 cases, despite voting overwhelmingly for Mr Biden at the ballot box and witnessing the violence of that ignominious day first-hand on their own doorsteps. Former Auburn football player Robert Shiver, whose wife Lindsay Shiver was charged with plotting to murder him, helped her and her alleged accomplices post bail. On 21 July, Lindsay Shiver, 36, her alleged lover Terrance Bethel, 28, and the purported hired hitman Faron Newbold, 29, were charged with plotting to murder the former football player. After their application for emergency bail was rejected on 28 July, the prosecution withdrew an objection to the trio’s release after hearing from Mr Shiver, according to Bahama Court News. All three of the accused were granted emergency bail on 1 August. According to Fox News, the three have been held at the Fox Hill Prison – the only detention centre in the Bahamas – since their arrest. Ms Shiver was granted $100,000 bail, and is required to wear an ankle monitor and stay in the Bahamas until her next court date: 5 October. The other two men each posted $20,000 bail, Bahama Court News reported, and also must wear monitoring devices. Mr Bethel and Mr Newbold will also be required to check in at the Marsh Harbour Police Station three times a week before 6pm. The men were also forced to stay in the Bahamas, as they had to surrender their travel documents. The accused will have to stay in detention until the court approves their bonds, the outlet said. Mr Shiver posting bail for his wife is a shocking turn of events as the Shivers are in the midst of a contentious divorce and custody battle over their three children. In addition to their home in the Bahamas, the couple also have a mansion in Georgia valued at $2.5m, which the pair are also arguing over. Mr Shiver filed for divorce for “adulterous conduct,” according to reports, while attorneys for Lindsay Shiver denied the affair, writing: “Any extramarital relationship defendant has had was during the parties’ separation and legally condoned by husband.” The next divorce hearing will be held on 31 October, Fox News previously reported. Donald Trump is on the defence after his third criminal indictment was handed to him this past week, lashing out at several people, including Nancy Pelosi, for providing commentary on his federal charges. The ex-president didn’t hold back against Ms Pelosi in a post on Truth Social on Sunday after the ex-speaker of the house said Mr Trump looked like a “scared puppy” attending his arraignment last week. “I purposely didn’t comment on Nancy Pelosi’s very weird story concerning her husband, but now I can because she said something about me, with glee, that was really quite vicious,” Mr Trump wrote. Ms Pelosi told MSNBC on Friday that when she saw Mr Trump emerge from his car for the arraignment in Washington DC she saw “a scared puppy” who “knows the truth that he lost the election”. Mr Trump appeared in federal court on Thursday to face four charges related to his alleged efforts and conspiracy to overturn the 2020 election results. The ex-president responded to Ms Pelosi’s comments, saying that he wasn’t “scared” of his arraignment and he thought her comment was “mean.” “She is a Wicked Witch whose husbands journey from hell starts and finishes with her. She is a sick & demented psycho who will someday live in HELL!” Mr Trump continued. Mr Trump’s comment was a reference to Ms Pelosi’s husband, Paul Pelosi, who was attacked in his own home by an intruder last year. The intruder and attacker, later identified as David DePape, intended to take Ms Pelosi hostage and interrogate her. During the attack, Mr Pelosi sustained several serious injuries to his skull, arm and hand. Reports found Mr DePape was entangled with far-right rhetoric online. Some of his views included subscribing to Mr Trump’s claims of widespread voter fraud in the 2020 election. Those claims are what have landed Mr Trump with a third criminal, and second federal, indictment. Mr Trump has been charged with conspiracy to obstruct an official proceeding, conspiracy against rights and obstruction of, and attempt to obstruct, an official proceeding. The charges stem from his alleged conspiracy to unlawfully change the results of the 2020 election in his favour. Ultimately Mr Trump’s claims of election fraud led to the January 6 riot that saw a mob of Trump supporters storm the Capitol building. Ms Pelosi was a target of rioters that day – some of who entered her office unlawfully. Following his arraignment, Mr Trump has spent time on his social media platform launching attacks on those who criticise him. Besides Ms Pelosi, the ex-president has attacked Mike Pence, Special Counsel Jack Smith, prosecutors in the Department of Justice (DoJ) and the judge presiding over his case.
